A high-stakes legal battle is brewing, involving a senior executive at Kaizer Chiefs and their spouse, as the executive's bid for divorce is met with staunch opposition. The matter has landed in the Johannesburg High Court, with the spouse filing papers to contest the divorce application.

The executive, one of Kaizer Motaung's children, initiated divorce proceedings last month, citing irreconcilable differences as the reason for the marriage's breakdown. The executive, who cannot be named for legal reasons, filed an application for a decree of divorce, stating that the marriage has irretrievably broken down and that there is no reasonable prospect of its restoration. The application details that the marriage was concluded out of community of property with accrual.

"The marriage relationship between the parties has irretrievably broken down and has reached such a stage of disintegration that there is no reasonable prospect for its restoration," the court papers state.

The executive further cited diverging ambitions, goals, and life pursuits as contributing factors to the marital discord. The application also seeks an equitable division of the couple's joint assets, with a request for the spouse to contribute financially towards the maintenance of their shared home.

The executive's proposed contribution towards the couple's children includes provision for food, medical aid, clothing, school fees, uniforms, extracurricular activities, transport, birthday gifts, and entertainment.

The spouse, who also remains unnamed for legal reasons, has formally indicated their intention to defend against the divorce application. Legal representation has been secured through the firm Biccari Bollo Mariano Incorporated.

The notice of intention to defend, filed last week, reads: “Pleased to take notice that the defendant hereby gives notice of her intention to defend the above-mentioned action. Be pleased to take notice further that the defendant hereby appoints the offices of Messrs Biccari Bollo Mariano Inc, 8a Bradford Road, Bedfordview 2007, as the address for service of all documents, pleadings and notices in the above-mentioned matter.”

This development adds a significant layer of complexity to the already sensitive situation. The executive's application included a challenge to the spouse to indicate within ten days whether they intended to oppose the divorce and division of assets. The application outlined the legal procedures the spouse must follow if they wish to contest the proceedings, including filing a notice of intention to defend within ten days of receiving the summons, followed by the submission of a plea, exception, or notice to strike out within a further twenty days. Failure to comply with these timelines, the application warned, could result in a default judgment against the spouse.

The case highlights the often-complex and emotionally charged nature of high-profile divorces, particularly those involving prominent figures in the public eye.
